These terms and conditions ("Terms") govern the use of services available on or through www.kaamsaathi.com and/or the Kaam Saathi mobile application (collectively, the "Platform"), and the services offered through the Platform (together, the "Services"). By accessing or using the Platform or Services, you agree to be bound by these Terms. These Terms also include our Privacy Policy and any additional or supplemental terms made available from time to time ("Supplemental Terms"). In case of any conflict between these Terms and the Supplemental Terms, the Supplemental Terms will prevail.
Kaam Saathi ("we," "us," "our") refers to the service platform owned and operated by Richter Brothers. By using the Services, you represent that you have full legal capacity to agree to and bind yourself to these Terms. If you represent any other person, you confirm you have the necessary power and authority to bind such person to these Terms.
(a) The Services include the Platform that enables users to schedule and request on-demand services through independent third-party service providers (“Service Providers”).
(b) The Pro Services are the services rendered by Service Providers, and Kaam Saathi does not employ Service Providers nor is responsible for the services they provide.
(c) The Platform is available for personal and non-commercial use within Mumbai, Maharashtra unless specified otherwise.
(d) Kaam Saathi facilitates payment processing to Service Providers for the services they render.
(a) To avail the Services, you must create an account on the Platform. You will be required to provide certain personal details, including but not limited to your phone number and email address.
(b) You represent and warrant that all information provided during registration is accurate and up-to-date. You are responsible for maintaining the security of your account and immediately notifying us of any unauthorized use or security breach.
(c) By creating an account, you agree to receive communication from us regarding payment requests, promotions, or service updates.
(a) You may submit reviews, ratings, or feedback about Service Providers through the Platform ("User Content").
(b) By submitting User Content, you grant Kaam Saathi a non-exclusive, worldwide, perpetual, irrevocable, and royalty-free license to use, display, and modify the User Content for purposes related to the operation of the Services.
(c) You are responsible for ensuring that the User Content you post does not violate any laws, infringe on intellectual property rights, or include harmful content.
(a) You consent to the collection, use, and processing of your personal data as described in our Privacy Policy.
(b) In addition, you consent to Kaam Saathi sharing your information with affiliates and third-party service providers to enhance the functionality and performance of the Services.
(a) To book a service, you must provide necessary information regarding the service request. Once the booking is confirmed, payment will be processed in accordance with the platform's payment options.
(b) All charges for services are subject to taxes, convenience fees, and any additional costs incurred for specific requests or services.
(c) We may offer promotional codes ("Kaam Saathi Credits") that can be redeemed for services. These credits are non-transferable and may expire at Kaam Saathi's discretion.
(a) Bookings may be canceled subject to Kaam Saathi’s Cancellation and Refund Policy.
(b) Cancellations made after the service provider has confirmed the booking may be subject to a cancellation fee.
(c) Refunds are processed according to the applicable policies for the specific service booked.
(a) You agree to pay for the services you avail through the Platform, including applicable service fees, taxes, and any other charges.
(b) Kaam Saathi reserves the right to modify its fees at any time and will provide notice of such changes through the Platform.
(c) Payments for services are processed through third-party payment gateways, and you agree to comply with the terms of those providers.
(a) You agree to use the Platform and Services for lawful purposes only and will not engage in discriminatory, abusive, or inappropriate behavior towards Service Providers.
(b) Kaam Saathi reserves the right to restrict or terminate your access to the Platform if you engage in any behavior that we deem inappropriate or unlawful.
(c) You are responsible for ensuring that the location provided for the services is safe, clean, and appropriate for the Service Provider.
(a) The Platform may include links to third-party services that are not operated or controlled by Kaam Saathi.
(b) Kaam Saathi is not responsible for the content or privacy practices of third-party services and encourages users to review their respective terms and policies.
(a) The Services are provided "as is" without any warranties. Kaam Saathi does not guarantee that the Platform will be error-free or uninterrupted.
(b) Kaam Saathi is not responsible for any damage or loss incurred as a result of using the services provided by Service Providers.
(c) In no event shall Kaam Saathi’s liability exceed the amount you paid for the specific service giving rise to the claim.
(a) Kaam Saathi may suspend or terminate your access to the Platform if you violate these Terms.
(b) You may terminate your account by contacting us at the provided support email.
(c) Upon termination, your access to the Services will be revoked, and any outstanding payments will remain due.
(a) These Terms shall be governed by the laws of Mumbai, Maharashtra.
(b) Any disputes shall be resolved through arbitration in Mumbai, Maharashtra, India, under the Arbitration and Conciliation Act, 1996.
(a) Kaam Saathi reserves the right to modify or update these Terms at any time.
(b) Any changes will be effective immediately upon posting, and your continued use of the Platform constitutes acceptance of the modified Terms.
